September 30th EB-5 Deadline

September 30th EB-5 Deadline

5 Months Left for EB-5 Investor Visa Program with Current Benefits

Dear Friends,

I am writing to notify you of an important change to the EB-5 Investor Visa Program that will take effect on September 30th, 2026. Please read through to see if you need to take action before that date.

The EB-5 program allows investors to obtain a Lawful Permanent Residency (U.S. Green Card) by investing at least $800,000 in qualifying projects. that stimulate the U.S. economy.

The EB-5 Regional Center Program, established in 1992, has enabled more than 100,000 investors and their families to obtain Green Cards. However, this Program is not permanent; it was last renewed in March 2022 and is set to sunset (expire) on September 30th, 2027, unless Congress acts to extend it again.

The current EB-5 law states that investors who file their EB-5 petitions by September 30th, 2026, have Grandfathering Protection. This means that they can complete their immigration process, even if the program is not renewed the following year. Investors who file their petitions after that date are not subject to Grandfathering Protection.

Upcoming EB-5 Statutory Deadlines

  • September 30, 2026: Last Day to File with Grandfathering Protection
  • January 1, 2027: Minimum Investment Amount Increases (Automatic Recalculation for Inflation)
  • September 30, 2027: The EB-5 Regional Program Sunsets

It usually takes 1-3 months to prepare and file a quality EB-5 petition.

If you believe this program might be right for you, I recommend scheduling a consultation with an immigration attorney to determine your eligibility for the program and to see if it makes sense for you to seek to file your EB-5 petition I-526E before September 30th, 2026.

I work exclusively as a FINRA-licensed investment broker, assisting investors with selecting an appropriate EB-5 project. I will be happy to work alongside your legal team to assist you through your EB-5 journey.

Sincerely,
Irina Rostova
